Information updated · Synergy Legal Services
Hearing that the other driver has no insurance does not answer every coverage question. There may be a dispute about the policy, vehicle owner or insured person. Synergy Legal Services can review the documents without promising that another policy will cover the loss.
Confirm what the insurer actually decided
Ask for written information identifying the policy and the reason coverage is unavailable. An expired policy, an excluded driver and a disputed use of the vehicle can raise different issues.
Save the other driver's details, vehicle ownership information, report number and correspondence. Do not rely only on an oral statement at the scene that there is no insurance.
Distinguish UM from UIM coverage
Uninsured motorist coverage and underinsured motorist coverage address different situations. The available benefits depend on the actual policy, covered person, limits and applicable rules.
Bring declarations, endorsements and any selection or waiver forms. Do not assume all household policies apply, that limits can be combined or that owning a policy guarantees payment.
Separate medical bills from vehicle losses
PIP, UM, UIM and collision coverage are not interchangeable. A medical payment decision does not necessarily resolve vehicle repairs or a claim for other losses.
Keep bills, benefits statements, repair costs and insurer decisions separately. Review any settlement or release before accepting it, because it may affect another coverage issue.
Prepare the facts for your consultation
Tell us whether you were a driver, passenger, pedestrian or cyclist and which policies may relate to you or the vehicle. Explain any denial, offer or payment already received.
A free consultation can identify what needs further review. It cannot guarantee that coverage or collectible funds exist. Ask about representation and expenses before agreeing to proceed.
Frequently asked questions
Will my own insurer always pay?
No. Eligibility, policy terms, limits and the type of loss matter. Review the actual coverage rather than assuming a claim is automatically payable.
Is underinsured the same as uninsured?
No. Underinsurance generally concerns insufficient applicable liability coverage, while an uninsured claim raises a different coverage issue. The policy and facts determine how either applies.
